Terms and Conditions
These Booking Conditions, together with any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with Ferme de Moudon ("we" or "us"). Please read them carefully as they set out our respective rights and obligations. In these Booking Conditions references to "you" and "your" include the first named person on the booking and all persons on whose behalf a booking is made.
By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:-
a. He/she has read these terms and conditions and the provider's terms and conditions and has the authority to and does agree to be bound by both of them;
b. He/she consents to our use of information in accordance with our Privacy Policy;
c. He/she is over 18 years of age and resident in the United Kingdom and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services.
1. Booking and Payment
When you have chosen the arrangements you wish to book and you make a request to us to book it, you must pay a deposit or the full cost of the booking if you are booking within 10 weeks of your arrival date.
No contract is made between us and you and no booking is valid (and accordingly we shall have no obligations to you) until we have issued a confirmation invoice. This confirmation invoice will be issued by us (if we accept your booking) only after we have received all applicable payments.
Please check your confirmation carefully and report any incorrect or incomplete information to us immediately.
If you have paid a deposit, the balance of the cost of your accommodation is due 10 weeks before departure. If it is not received in time we will treat your booking as cancelled by you and the cancellation changes in clause 6 will apply.
2. Prices and accuracy
We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised and confirmed prices and other advertised information. We endeavour to ensure that all the information and prices we advertise are accurate, however occasionally changes and errors occur and we reserve the right to correct prices and other details . You must therefore check the current price and all other details relating to the arrangements that you wish to book before your booking is confirmed.
EXTRAS AND OTHER SERVICE PROVIDERS
The Fee includes the amenities and the services as published on our website or in our brochure. We can arrange some extra amenities for you which we provide directly to you for an additional charge ("Additional Fees"). If you choose to book any of these services, you shall provide us with your credit card details and authorise us to collect payment for the Additional Fees from your credit card at the end of your stay.
The Fee does not include transfers, lift passes, equipment hire, ski lessons/guiding and other services (which are provided by other service providers). We can recommend certain service providers to you for these services and will provide more details if requested and when you arrive.
3. Your responsibility for your booking
When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. This means that you are responsible for making all payments due, notifying us if any changes or cancellations are required and for receiving the confirmation and keeping your party informed.
4. Insurance
It is your responsibility to ensure that you are adequately insured. We strongly recommend that you take out insurance, which should include cover against the cost of cancellation by you and assistance (including repatriation) in the event of accident or illness.
5. If you want to change your booking
After our confirmation has been issued, any requests for changes must be sent to us in writing, by email, fax or post, by the person that made the booking. We can't guarantee that we will be able to accommodate your request but we will try to do so. You will be asked to pay an administration fee and any other charges imposed by any supplier. These are likely to be higher the closer you get to your arrival date, so contact us as soon as you can.
If you change the number in your party, the price may be re-calculated. If the party size is reduced, this is likely to mean the remaining members paying more due to under-occupancy.
6. If you want to cancel your booking
If you or any other member of your party decides to cancel your confirmed booking you must notify us in writing. Your notice of cancellation will only take effect when it is received in writing by us at our offices. We recommend that you use recorded delivery. Since we incur costs in cancelling your arrangements, you will have to pay the applicable cancellation charges shown below.
Note: If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.
Cancellation fees:
More than 70 days before your arrival date: deposit
Between 56 and 69 days: 50%
Between 42 and 55 days: 75%
Within 41 days of arrival date: 100%
Charges are shown as a percentage of the cost or your arrangements (excluding amendment fees, if any, which are non-refundable in the event of a cancellation).
7. If we change or cancel your booking
We reserve the right to change or cancel your booking.
Subject to the note below, if we make a material change and you don't want to accept it, you can take any alternative arrangements we are able to offer you (you will pay the increase in cost if the replacement is advertised at a higher price than your original booking, or receive a refund of the difference if it is less expensive) or a refund of the money you've paid to us. This does not apply where the change is not material. Examples of non-material changes include, but are not limited to, temporary withdrawal of facilities or seasonal unavailability of amenities.
Subject to the note below, if we have to cancel, again we may be able to offer you an alternative. If you accept it, you would pay the difference if it was advertised at a higher price than your original accommodation, or receive a refund of the difference if it was advertised at a lower price. If you don't want to accept an alternative or we don't have one to offer you, we will refund the monies you have paid us.
We will not be responsible to pay any compensation following a change or a cancellation by us. Any amendment or cancellation fees you incur in terms of other arrangements you have made with other providers under separate contracts are not claimable from us. The above options are not available where any change is a minor one or where the changes or cancellation by us arises out of alterations to the confirmed booking requested by you.
Note If a change or cancellation occurs because of circumstances beyond our control, for example war, riot, industrial dispute, actual or threatened terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions, flood, epidemic or pandemic illness and all similar situations we will have no liability to you. No compensation, costs, expenses or any other sums, including the cost of securing alternative arrangements will be paid by us.
8. Our responsibility for your booking
We accept responsibility if the arrangements which we contract to provide are deficient or not of a reasonable standard. Subject to these Booking Conditions, we will accept responsibility should you or any member of your party suffer death, personal injury, illness or other loss or damage which you can prove results from any failure to take reasonable skill and care in performing any part of our contract with you by any of our employees, agents, sub-contractors or suppliers (providing they were at the time carrying out work authorised by us) except in the following situations. We will not be liable where any failure to take reasonable skill and care in performing the whole or any part of our contract was due to:
(a) the act(s) and/or omission(s) of the person(s) affected;
(b) the act(s) and/or omission(s) of a third party not connected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
(c) unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or
(d) an event which either ourselves, our employees, agents or suppliers and subcontractors could not, even with all due care, have foreseen or forestalled.
We also have no liability in the following situations:
(i) where the arrangements cannot be provided as booked due to circumstances beyond our control (see the Note in clause 7).
(ii) where you incur any loss or damage that could not have been foreseen at the time of your booking, based on the information provided by you.
(iii) where you incur any loss or damage that relates to any business activity.
(iv) where any loss or damage relates to any services which do not form part of our contract with you.
If we are found liable to you on any basis, we limit the amount we have to pay you to a maximum of twice the cost of your arrangements. This limit does not apply to cases involving death or injury.
9. Behaviour
When you book arrangements with us, you accept responsibility for the proper conduct of all members of your party during your stay. We reserve the right at any time to terminate the stay of any party member(s) whose behaviour is such, in the reasonable opinion of the provider of the arrangements or us, as to cause or to be likely to cause danger, upset or distress to anyone else or damage to property. Full cancellation charges will then apply and no refund will be given.
Furthermore, we shall be under no obligation whatsoever to pay compensation or meet any costs or expenses you may occur as a result of your arrangements being terminated.
Many of the interior furnishings in Ferme de Moudon are antique / bespoke items and therefore carry a considerable value. If you cause damage to the furnishings or the property or structure in which you are staying, you must fully reimburse us for the items concerned for the cost of the damage before the end of your stay if the cost has been established by then or as soon as it has been established if later. You must also repay us the full amount of any claim (including all legal costs) made against us by the accommodation provider or any third party as a result.
Smoking
Due to the wooden construction of the chalet and out of general consideration for others we operate a strict no smoking policy in Ferme de Moudon. Clients who wish to smoke are able to do so on the outdoor balcony areas or in the grounds of Ferme de Moudon. When using the outdoor balconies it is your responsibility to use the ashtrays provided and to ensure that all cigarettes/cigars are fully extinguished and represent no fire hazard.
10. Complaints
If you have a problem during your stay, please inform the provider of your arrangements immediately, who will endeavour to put things right. You should also try to find a solution whilst you're there. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to us giving your booking reference and all other relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.
If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint whilst you were in resort and this may affect your rights under this contract.
Please bear in mind that we are only liable to compensate you in line with these booking conditions.
These Booking Conditions and any agreement to which they apply are governed in all respects by UK law. We both agree that any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with by the Courts of United Kingdom.
